It featured Betta, Highway Song and a small bit of Euphoria. Some of the mega ski-bums from my school made their own ski movie and it had Funky Mountain Fogdown in it. I was pretty psyched because usually Warren Miller movies have too much Big Head Todd and quite a bit of Samples, but this year, each were toned down and Salmon took their place. Next year, I have a feeling String Cheese May make it, but who the hell knows. Sorry to repost, because I saw the movie way after it came out, I hope this isn't redundant. Trying control people's actions was in such an atmosphere is some way like trying to grab sand, Kesey reportedly explained. The tighter you try to hold on to it, the quicker it will slip through your fingers. Three generations of live concert taping has witnessed similar dynamics. At various times, different interests within the music industry become more active in trying to limit or stop the recording and trading of such recordings. We have apparently entered another of these periods. A brief comparison of the issue in 1953 and today might be useful. Significantly, some of the most active agents in trying to prevent tapers from recording live music in 1953 (the reel-to-reel tape recorder became popular after WWII) were from the musician's union. The American Federation of Musicians made it national policy that all requests to tape performances required a *union-issued contract*, specifying payments *to the union* for permission to record live music. Ralph J. Gleason understood the futility of the musicians union's attempts to restrict the taping of live concerts. Already by the early 1950s, Gleason pointed out, tape-traders comprised an *international* network. This was not a threat to the economic interests of the unions or the artists. The vast majority tapers and traders were simply music lovers engaged in a non-profit hobby. Tapers were (and are) very dedicated; they would do (and still do) whatever was necessary to catch the sounds of great live music on tape. Microphones were hidden in rafters and tape decks were smuggled in to concert halls and jazz clubs by the early 1950s. (With the advancements in technology this has become easier and the quality of such recordings has greatly increased.) As long as it was practiced with not-for-profit ethics, Gleason argued, was not only no economic threat to the musicians. It was "an exciting new field." Tape collecting and trading was also unstoppable, since live concerts were frequently broadcast over the radio. In 1998 it is the recording industry's trade organization that has begun taking action against tape traders. The RIAA recently entrapped a man doing "two-for-one" trades into a deal over the internet. The RIAA insists the man was making a profit by requiring a new tape trader to send two blank tapes to him in return for one of those tapes mailed back with a live concert on it. But "two-for-one" trades are already considered unethical within the taping community and are frowned upon. Only "newbies" to the field would take advantage of such offers, since one-for-one trades are the standard and are readily available over the net. This one bust would be relatively unremarkable in and of itself. But it seems that the RIAA considers this action just an opening salvo in a new war on tapers. The RIAA has recently sought to have Internet Service Providers cancel accounts of legitimate tapers who list tapes of artists that are anti-taping on-line, even when the tapes are not being circulated for profit. It is very interesting that it is now the recording industry rather than an artists union trying to enforce bans on tape-trading. The industry will learn -- sooner or later -- what the musicians union began learning 45 years ago. The results of attempting to enforce unenforceable prohibitions are predictable. The RIAA will find that their every action will have an equal and opposite reaction. If the RIAA inhibits legitimate, ethical tape trading it will actually encourage the very crime it seeks to prevent: the bootleg *sales* of live concert tapes. Coupled with the fact that the emerging consensus among artists is that not-for-profit tape-trading of their live music enhances rather than competes with their commercial interests, the RIAA's actions are ill-conceived, at best. In fact, no matter who is trying to prohibit concert-taping and tape-trading -- artists, venues, industry, and/or government -- they will find the experience not unlike trying to grab sand. The tighter they try to grasp a hold of it, the faster and more thoroughly control will slip through their fingers. The RIAA has made its point. The taping community has been put on notice that "two-for-one" trades are unacceptable.
